Each adoption contract contains specific information about the Bengal cat in particular that is being adopted and specific information about both the Breeder and Adopter. This agreement is tailored to a pet/companion adoption and does not include some of the conditions that apply to breeding Bengal adoptions. Nemera Bengals – Pet/Companion Bengal Adoption Agreement

Breeder and Adopter mutually agree to and acknowledge with their dated signature below, each of the following Terms and Conditions:
- Payment/Adoption Fee:
Breeder will transfer ownership to Adopter, the Bengal cat in exchange for the adoption fee of _____US Dollars ($ 00.00) which includes the non-refundable reservation and medical expenses fee of _____US Dollars ($ 00.00) that was paid via Paypal Unique Transaction ID# ______ and the delivery fee of _____US Dollars ($ 00.00). The remaining balance of _____ US Dollars ($ 00.00) MUST be paid in full before the Bengal cat will leave Breeder’s possession. Disputes, if any, regarding payments made via PayPal will NOT be disputed through PayPal but must be handled privately. The International Cat Association (hereafter “TICA”) Purebred Registration papers will not be sent for processing until the adoption fee is paid in full; there is no exception. - Adopter’s Responsibility:
Adopter accepts the responsibility of caring for the Bengal cat at their own cost and will provide properly for its welfare. Adopter will provide at minimum: adequate food, clean drinking water, shelter, proper access to litter or other relief area, human companionship, and care as needed by a licensed Doctor of Veterinary Medicine (hereafter “DVM”). Adopter will provide all necessary veterinary care in a timely manner and in the best interest of the Bengal cat. If, at any time, Adopter can no longer provide for the Bengal cat any of these items/services for any reason, Adopter will contact Breeder and Breeder will reclaim the Bengal cat without compensation to Adopter. In the event of reclaim, it will be Adopter's responsibility, at their own cost, to transport the Bengal cat to Breeder. Breeder may elect to help Adopter arrange transport back to Breeder or find a new home for the Bengal cat without reclaiming it. If an when the Adopter must give up ownership of the Bengal cat, an additional agreement will be enacted and it will be signed by both parties. - Health Guarantee and Requirements:
Adopter will have the Bengal cat examined by a DVM within seventy-two (72) hours after they take possession. This is the health guarantee period. If the Bengal cat is found to have contagious disease, congenital health defect, or life threatening condition by a DVM within the seventy-two (72) hours time frame, the Bengal cat shall be returned at Adopter's expense to Breeder within seven (7) days of the exam and arrangements for a replacement will be made. Breeder will be given one (1) year from the date of return of the Bengal cat to Breeder’s possession to provide a replacement of Breeder’s choice and comparable value. Adopter may decline to return the Bengal cat and in doing such will assume responsibility of any medical expenses. A medical report signed by the examining DVM must be provided to Breeder within twenty-four (24) hours of the examination in order to secure a replacement. There shall be no returns/replacement unless under the Health Guarantee with ALL conditions met. Breeder will not replace any cat that has not received adequate and appropriate care from Adopter. It is Adopter’s responsibility to provide immediate Veterinary care, at their own expense, to the Bengal cat showing signs of illness or distress. Failure to provide this care will render any and all guarantees null and void, as well as, the Adopter will forfeit ownership and Breeder will reclaim the Bengal cat without compensation to Adopter by whatever legal means necessary. - Quarantine Requirements:
Adopter will quarantine the Bengal cat in a room with absolutely NO contact with any other animals for no less than seven (7) days of arrival in Adopter’s home AND until the Bengal cat has been examined by a DVM for good health. Adopter will provide in the quarantine room: a sleeping place, clean litter box, food (regular meals), and fresh water. If quarantine requirements are not met, all guarantees are null and void. Note: Breeder recommends a quarantine of no less than fourteen (14) days to ensure the Bengal cat is not ill and also to reassure the Bengal cat that they are safe in their new home. This is the Breeder’s protocol when bringing in new kittens/cats. A small room such as a bathroom is perfect for this. A room with FEW hiding places is best. This is especially important if the Bengal cat has been transported via an airline. - HCM Guarantee:
Hypertrophic cardiomyopathy (HCM) is a common disease in cats, but especially Bengal cats. Breeder screens their adult cats for this disease regularly. For this reason, Breeder agrees that if the Bengal cat dies as a direct result of HCM before the age of three (3) years (03/21/2019), Breeder will replace Bengal cat with a Bengal cat of Breeder’s choice and comparable value within one (1) year of the death, if and only if, the cause of death is documented through necropsy by a DVM to prove the death was a direct result of HCM. The cost of the necropsy is the responsibility of the Adopter in order to secure a replacement. Delivery/transportation cost (if any) for the replacement is the responsibility of the Adopter and will be the only cost associated with replacement of the Bengal cat under this condition. - Health Records:
The Bengal cat has received all appropriate veterinary care for their age. Details of veterinary care will be provided by Breeder in the Pet Health Record. - Vaccinations:
Adopter will maintain vaccinations to ensure the health and well-being of the Bengal cat. Vaccinations that have been administered are listed on the Health Record with the date administered and the vaccine label. Adopter MUST keep Rabies vaccination up to date as required by law in the state/city/country which Adopter resides. Adopter will not administer or have administered Feline leukemia (FeLV) or Feline infectious peritonitis (FIP) vaccine to the Bengal cat at any point in time for any reason so long as it shall live. If this term is not met, any and all guarantees become null and void. Reference: Feline Infectious Diseases, Chapter 7, page 54, by Niels C. Pedersen, D.V.M. Ph.D. - Microchip:
The Bengal cat has been implanted with a microchip for permanent identification. Adopter will register the microchip online or by using the form provided by Breeder within fourteen (14) days of the date of this agreement and will ensure to place Breeder's information as the alternate contact in case Adopter cannot be reached should the Bengal cat become lost or stolen. Adopter will not remove or have removed the microchip for any reason. If the microchip is removed, Adopter will forfeit ownership and Breeder will reclaim the Bengal cat without compensation to Adopter by whatever legal means necessary. - Restriction of Breeding Rights and Fertility Guarantee:
This kitten was purchased as a Pet/Companion ONLY and is not for breeding. The Fertility Guarantee does NOT apply. The Bengal cat will be spayed/neutered BEFORE delivered/picked up. There is no exception. - TICA (Purebred) Registration and Show Rights:
Breeder will register Bengal cat in Adopter’s name with The International Cat Association (TICA) at no cost to Adopter with the name Adopter has chosen. Registration papers will be mailed when completed by TICA to Adopter’s address as recorded below. Breeder will allow the Bengal cat to be shown in any TICA show if the Bengal cat is eligible for show by generation (F4 and higher). Breeder does not guarantee for show quality, personality, or wins. Breeder does not guarantee against cosmetic faults (crossed eyes, tail fault, locket, etc). - De-clawing and De-vocalization:
Adopter will not under any circumstances allow the Bengal cat to be de-clawed or de-vocalized by ANY method available. These methods include but are not limited to onychectomy, tendonectomy, and laser surgery. Subjection of the Bengal cat to these surgeries or any other de-clawing/de-vocalization method by Adopter will be considered animal abuse and will result in Adopter will forfeit ownership and Breeder will reclaim the Bengal cat without compensation to Adopter by whatever legal means necessary. - Outdoor Free Roaming and Enclosures:
Adopter will never allow the Bengal cat to roam freely outdoors for ANY reason. Adopter will not allow the Bengal cat outside without a being secure in a carrier, with a leash and harness/collar, or in an escape-proof enclosure. If the Bengal cat is placed in an enclosure, Adopter will provide proper shelter from the elements and an adequate supply of food and water. Adopter will notify Breeder within twenty-four (24) hours in the event that the Bengal cat escapes or is otherwise lost (see Item #13). - Lost, Stolen, or Dies:
In the event the Bengal cat becomes lost, is stolen, or dies, Breeder will be contacted within twenty-four (24) hours of the loss, theft, or death. In the event of death, Adopter agrees that Breeder will be given certification of death within thirty (30) days of the death (I.e. signed letter from attending DMV). This item is especially important if suspected cause of death is HCM and warrants a replacement (see Item #5). - Re-homing and Re-sale:
Adopter will never sell, lease, or give the Bengal cat to ANY pet shop, animal dealer, animal research facility, animal shelter, Humane Society, animal broker, or to anyone who has ever been convicted of animal neglect or cruelty, NOR shall it be abandoned. It is the intention of Breeder that Adopter is to be a permanent placement home for the Bengal cat. In the event that Adopter cannot/will not keep the Bengal cat, see Item #2 for instructions. - Abuse, Neglect, and Mistreatment:
In the event that Adopter convicted in a Court of Law of animal cruelty or similar offenses against the Bengal cat or any other animal and/or convicted of any other violent crime, Adopter will forfeit ownership and Breeder will reclaim the Bengal cat without compensation to Adopter by whatever legal means necessary. If Adopter is so convicted, Adopter will make this adoption agreement available to the Court by any means necessary so that the Bengal cat may be returned to Breeder. Any and all fees associated with the recovery of Bengal cat shall be paid by Adopter, including, but not limited to, any and all court costs and attorney’s fees. Acts of animal cruelty shall include, but not be limited to, leaving the Bengal cat alone without human companionship for periods in excess of seventy-two (72) hours, lack of clean and proper elimination facilities, lack of food or water, lack of proper shelter, and/or physical abuse of any kind. - Euthanasia:
Adopter will not destroy (put down/euthanize) the Bengal cat without first contacting Breeder. Breeder will be given first right to reclaim the Bengal cat without compensation to Adopter in the event that Adopter wishes to destroy the Bengal cat for any reason other than as a result of an order from a Court of Law or the Bengal cat is suffering from an incurable illness or other issue as confirmed in writing by a DVM. In such case, Adopter will provide Breeder with documentation of Court Order or illness, dated and signed by the Judge or DVM, before the Bengal cat is to be destroyed. - Adopter/Breeder Communication:
Both parties will keep each other up to date with all name, phone number, and address changes so long as the Bengal cat lives for the safety of the Bengal cat. Both parties will protect this information and will not give it to any person or use in any way other than in the interest of the Bengal cat. Breeder allows for Adopter to contact them between 9 am – 10 pm PST by any means necessary except uninvited visits in person to Breeder’s home in the interest of the Bengal cat. Breeder will respond to any communication within seventy-two (72) hours of receipt. Breeder's personal cell phone number is NOT to be given out. - Refunds and Replacements:
Adopter understands Breeder is not required to offer cash/monetary refund of any kind for any reason. Adopter agrees that any offer for replacement in any case will be in writing and signed by both parties. Any other offer is not valid. If the Bengal cat should die before Adopter takes possession all monies paid are transferable to another Bengal cat of similar value and Breeder shall have up to one (1) year to provide reasonable replacement. Replacement will not be offered for any reason other than contained herein. - Multiple Kitten Discount:
Any Adopter of a Pet/Companion Bengal cat at the full adoption fee is offered a ten percent (10%) discount off the price of a second Bengal cat, if and only if, the second Bengal cat is to be adopted within one (1) year after the first. This discount will apply to adopting two kittens from the same litter. This discount will not apply if the first Bengal kitten becomes lost, is stolen, or dies. This discount will not apply to Bengal cats over the age of eight (8) months at the time of adoption or to any Bengal cats adopted for breeding purposes. This discount will not apply to Bengal cats adopted as rescue or at reduced fee. - The Entire Agreement:
Both parties agree that this is the entire agreement between parties. The agreement is five (5) numbered pages beginning with the words “Nemera Bengals” and ends with the words “***NOTHING FOLLOWS***.” Any agreements not contained herein are void. - Legal Action:
Any legal action that may arise in order to enforce the terms and conditions of this agreement will be brought in the State of Washington in the county in which Breeder resides at such time. Adopter shall be liable for any court costs and related charges including attorney's fees associated with Breeder enforcing the terms of this agreement. Both parties will retain a copy of this agreement signed by both parties. If any portion of this agreement is found to be illegal in a Court of Law, all other portions will remain valid. - Acknowledgment of Reading and Understanding:
Adopter has read and understands this agreement in its entirety and has resolved any questions or concerns they may have had before signing below. This agreement contains the entire agreement between parties as described in Item #20.
